Former NFL star Marcellus Wiley accused of 'viciously' raping woman in fresh legal blow after estranged wife's domestic violence claims

Former NFL star Marcellus Wiley has been accused of raping a 22-year-old student during his time with the Buffalo Bills over two decades ago, according to a bombshell lawsuit.

A woman, identified only as Jane Doe, filed a sexual battery lawsuit in Los Angeles County on Tuesday, alleging that the former Pro Bowler assaulted and ‘viciously’ raped her in an LA hotel room in 1999.

She claims that the alleged incident occurred nearly 28 years ago while she was a college senior at USC, according to the lawsuit obtained by The Daily Mail.

The Daily Mail has reached out to Wiley for comment but did not receive an immediate response.

The woman alleged that she first met Wiley in February 1999 and that they went on a couple of dates together during which she reportedly stated that she was not interested in pursuing a sexual relationship.

‘Around that time,’ Doe’s lawsuit stated, ‘Jane told Wiley that she was not sexually active, was sexually inexperienced, and was not interested in or willing to have a romantic relationship with Wiley or anyone.’

The lawsuit claims that later that month she and Wiley went out to a nightclub together in Los Angeles before the football player ‘pleaded’ with her to return to his hotel.

She allegedly believed they would hang out in the lobby before going their separate ways. However, inside the hotel foyer, Wiley repeatedly pressured Doe to spend the night with him in his room, according to the filing.

Doe claims she eventually relented but ‘repeatedly and explicitly’ told Wiley that she was not interested in having sex and would be going straight to bed, which he allegedly acknowledged.

She is said to have fallen asleep fully clothed but awoke later in the night when she felt his erect penis pressing against her leg, per the lawsuit.

Doe alleges that Wiley then climbed on top of her and raped her despite her repeated pleas for him to stop.

The lawsuit claims that ‘she feared that he would hurt her if she fought him, so she tried to reason with him calmly and repeatedly said, “No,” “Please stop,” and “Don’t do that.”’

Doe was allegedly left ‘terrified and in pain’ as she attempted to push back against Wiley but his size overpowered her.

At one point, Doe claims in her suit that Wiley ‘observed her shaking and said, “Look at you… keep shaking.”‘

Wiley allegedly drove Doe back to her USC dorm room the next morning, when he informed her that he had ‘the clap’ – a slang term for gonorrhea – and that she should get tested for sexually transmitted diseases. She claims that they never spoke again.

She says that she reported the assault and rape to her supervisor at the USC Student Health Center and had a rape kit administered at a hospital, which she claims tested positive for bruising and Wiley’s semen.

She also allegedly filed a police report over the matter but was later informed that Wiley denied the allegations and that prosecutors would not be moving forward with filing criminal charges.

Doe is now suing Wiley for sexual battery, assault, battery and intentional infliction of emotional distress.

‘Jane Doe brings this lawsuit to hold Wiley accountable, to recover for the severe and lasting trauma Wiley inflicted on her, and to deter him from ever again committing sex crimes against women,’ her lawsuit reads.

Doe’s attorney, Noah Werksman, told The Daily Mail: ‘Today marked an important day for my client who seeks to right a wrong committed by Marcellus Wiley many years ago. It’s an honor to represent her.’

The lawsuit comes after Wiley’s estranged wife, Annemarie, accused the former NFL player of domestic battery earlier this year. The case was dropped in August and Wiley will not face charges.

An arrest affidavit on July 4 alleged Wiley threatened to kill his wife in an Orlando hotel room and became physical with her in front of their children. Annemarie told police that Wiley stood over her on the morning of July 3 and ‘used one finger to sternly and intentionally poke her in the cheek,’ before threatening to kill her.

However, an August filing in Orange County state court stated that testimony was ‘not corroborated by any physical or other evidence’ and therefore the state of Florida would not be filing criminal charges as it was ‘insufficient to obtain a conviction.’

Wiley was also recently hit with sexual assault allegations from four accusers earlier this year.

The claims, filed over five months ago in New York, broaden the litigation that began in 2023 when three women accused Wiley of rape during his time at Columbia University.

Among the new accusers is a former ESPN production assistant who claimed Wiley lured her into a hotel room under the guise of a work meeting in 2009.

Wiley has denied all wrongdoing in all cases.
