Boys accused of sexually assaulting girl, 12, in Spain get one-week suspension

A group of children accused of sexually assaulting a 12-year-old girl were handed a one-week suspension in Spain as they are under the age of criminal responsibility.

The alleged attack by five or six classmates happened during a birthday party at a public venue outside their school in Burgos, northern Spain.

It was first reported to the police last month by the girl’s heartbroken family, which led to an investigation into the claims. The girl is understood to have been left traumatised by the alleged attack, according to Diario de Burgos.

Officers confirmed those involved are aged just 11 or 12, but as the age of criminal responsibility is 14, they cannot face prosecution, meaning the youngsters fall below the legal limit and will escape criminal charges for the alleged incident.

Education chiefs in Burgos, along with the wider school community across the region, are understood to be fully aware of the case. The police force passed the full report on the alleged attack to the Juvenile Prosecutor’s office.

The accused students were initially expelled, yet were permitted to return to the classroom one week later, with both the alleged victim and the accused returning to lessons.

The boys are currently being kept separate from other pupils, alongside several classmates, in a move said to “avoid their stigmatisation”.

It comes after a separate incident in which Spanish police say they are investigating alleged sexual assaults on up to 10 teenage girls who claim they were sexually assaulted on a cruise after their drinks were spiked.

A spokesman for the Civil Guard in Barcelona said: “We were made aware of alleged incidents involving minors when the cruise liner docked here on May 1. The possible authors would be adults.

“Officers received several complaints and have taken a number of statements and an investigation is ongoing. A local court has been informed and it will be up to the court to determine what happens next.”

No arrests have yet been made but it is understood the suspects have been identified and located.
